Right of Withdrawal for Consumers

(Consumer is any natural person who enters into a legal transaction for purposes that are predominantly not attributable to their commercial or independent professional activity.)

Right of withdrawal

"You have the right to withdraw from this contract within one month without giving any reasons. The withdrawal period is one month from the day,"

• at which you or a third party named by you, who is not the carrier, have taken possession of the goods, provided that you have ordered one or more goods as part of a single order and these are delivered uniformly.
• at which you or a third party named by you, who is not the carrier, have taken possession of the last item, provided that you have ordered multiple items as part of a single order and these are delivered separately;
• at which you or a third party named by you, who is not the carrier, have taken possession of the last partial shipment or the last piece, provided that you have ordered a product that is delivered in multiple partial shipments or pieces;

 

To exercise your right of withdrawal, you must inform us (Erol Kaplan, Zypressenstraße 69, 59071 Hamm, Phone: 02381 42 66 118, Email: info@gewofit.de) by means of a clear declaration (e.g. a letter sent by post, fax, or email) about your decision to withdraw from this contract. You can use the attached sample withdrawal form for this purpose, but it is not mandatory.

"You can also fill out the sample cancellation form or another clear declaration electronically on our website (https://gewofit.de/) and submit it. If you make use of this option, we will promptly send you a confirmation of the receipt of such a cancellation (e.g. by email)."

To maintain the cancellation period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the cancellation period expires.

Consequences of the revocation

"If you revoke this contract, we will refund you all payments we have received from you, including delivery costs (except for additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), without delay and no later than 14 days from the day on which we receive the notification of your revocation of this contract. For this refund, we will use the same payment method you used for the original transaction, unless something else has been expressly agreed with you; in no case will you be charged any fees for this refund."

"We can refuse the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier date."

You must return or hand over the goods to us immediately and in any case no later than 14 days from the day on which you inform us of the cancellation of this contract. The deadline is met if you send the goods before the 14-day period has expired.

We bear the costs of returning the goods.

"You are only liable for any potential loss in value of the goods if this loss in value is attributable to handling them in a manner that is not necessary for the examination of their nature, characteristics, and functioning."

Exclusion or termination reasons

The right of withdrawal does not exist for contracts

• for the delivery of goods that are not pre-fabricated and for whose production a significant choice or determination by the consumer is essential or that are clearly tailored to the personal needs of the consumer;
• for the delivery of goods that may spoil quickly or whose expiration date would be exceeded quickly;
• for the delivery of alcoholic beverages, the price of which was agreed upon at the conclusion of the contract, but which can be delivered no earlier than 30 days after the conclusion of the contract and whose current value depends on fluctuations in the market to which the entrepreneur has no influence;
• 'for the delivery of newspapers, magazines, or illustrated publications, with the exception of subscription contracts. The right of withdrawal expires prematurely in the case of contracts'
• for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene, if their seal has been removed after delivery;
• for the delivery of goods, when they have been inseparably mixed with other goods due to their nature after delivery;
• for the delivery of audio or video recordings or computer software in a sealed package, if the seal is removed after delivery
